WHEREAS, Ronald A. Moore and Denise L. Moore, Husband and Wife, by their Deed of Trust dated May 13, 2005, and recorded in the Recorder’s Office for Douglas County, Missouri, as Document No. 081508, conveyed to Rondo D. Prock, Grantee/Trustee, the following described real estate, situated in the County of Douglas, State of Missouri, to-wit:

A part of the NE¼ SE¼ and the SE¼ NE¼ of Section 18, Township 27, Range 15, Douglas County, Missouri, described as beginning at a point where the “Public Road” intersects the West line of the NE¼ SE¼, from this point run thence North 931 feet along the West line of said NE¼ SE¼ and the SE¼ NE¼, from this point run East, 400 feet, thence run South 21½ degrees East, 468.7 feet and to a point; said point being 572 feet East of the West line of the SE¼

NE¼; from this point run on an angle of South 30 degrees West, 345.8 feet and to a point; said point being 400 East of the West line of the SE¼ NE¼; from this point run South and to the Westerly right-of-way line of Missouri State Highway 5, thence follow said Highway right-of-way line to a point where the “Public Road” (Road leading into the ‘ROADSIDE PARK’) intersects said Highway right-of-way, thence follow said Public Road and to the POINT OF BEGINNING.

SUBJECT to the reservation of an EASEMENT for ingress and egress over and across the private road as it now runs from its point of intersection with the “Public Road” and running in a Northeasterly direction and leading into land lying to the east of the above described tract and being in the E½ NE¼ of Section 18, Township 27, Range 15.

ALSO SUBJECT to right-of-way for State Highway 5 and the Public Road, as they now run.

which conveyance was made to said Rondo D. Prock, Grantee/Trustee, in Trust, to secure the payment of a certain note in said Deed of Trust described; and

WHEREAS, it is provided in and by the terms of said Deed of Trust that in case of the absence, death, or refusal to act, or disability in anywise, of the Grantee/Trustee, at the request of the legal holder of said note, the (then) acting sheriff of Douglas County, Missouri, may proceed to sell the property hereinbefore described; and

WHEREAS, Rondo D. Prock, Grantee/Trustee, died on February 28, 2012; and WHEREAS, Chris Degase, Sheriff of Douglas County, Missouri, has been appointed Successor Trustee by the holder of the note; and WHEREAS, default was made and still continues in the payment of said note.

NOW, THEREFORE, at the request of the legal holder of said note, and in pursuance of the provisions of said Deed of Trust, the undersigned Successor Trustee will sell the property above described at public venue, to the highest bidder for cash, at the North Door of the Douglas County Courthouse in the City of Ava, State of Missouri, on Monday, August 15, 2016 between the hours of 9:00 a.m. and 5:00 p.m., to-wit: at 1:00 p.m., for the purpose of satisfying said indebtedness and the cost of executing this trust.
