NOTICE OF SUCCESSOR TRUSTEE’S SALE

For default in the payment of principal and interest now past due on a certain promissory note dated December 24, 2002 and a loan modification agreement dated November 30, 2004 and secured by a deed of trust dated December 24, 2002 signed by Nina Orchard, surviving spouse of James A. Orchard deceased April 20, 1997, and recorded on January 3, 2003, in Book 400 at Page 1067 as Document #030026, in the Office of the Recorder of Deeds for Douglas County, Missouri, Lee J. Viorel, III will, at the request of the legal holder thereof, on Monday, the 15th day of December, 2014, between the hours of 9 o’clock a.m. and 5 o’clock p.m., specifically at 1 o’clock p.m. at the North Door of the Douglas County Courthouse, located at 203 Southeast 2nd Avenue, in the City of Ava, Missouri, sell at public vendue to the highest bidder for cash, the property in the deed of trust described as:

All that part of the NE ¼ SW ¼ of Section 23, Township 27, Range 16, described as: Beginning at a point 970 feet East of the NW corner of said forty, from this point run thence South 125 feet, thence run West 250 feet, thence run South 369 feet, thence run East and to the West right of way line of Highway “B” (Z), thence follow said West right of way line in a Northeasterly direction and to the point of intersection with the North Line of said forty, thence run West, along said forty line and to the point of beginning, except all that part of the NE ¼ SW ¼ of Section 23, Township 27, Range 16, described as beginning at a point 970 feet East of the NW corner of said forty, for a true point of beginning, from this point run thence South 125 feet, thence run West 250 feet, thence run South 100 feet, thence run on a straight line, in an Easterly direction, and to the point of intersection with the West right of way line, of Highway “B” (Z), at a point being 250 feet South of the North line of said NE ¼ SW ¼, thence follow said West right of way line in a Northeasterly direction and to the point of intersection with the North line of said forty, thence run West along said forty line and to the true point of beginning. Also except that part of the NE ¼ SW ¼ of Section 23, Township 27, Range 16 described as beginning at a point 970 feet East of the Northwest corner of said forty and run thence South 125 feet, thence West 250 feet, thence run South 98 feet, thence run in an Easterly direction and to the West right of way line of State Highway “B” (Z), being at a point on said Highway 270 feet South of the North line of the NE ¼ of the SW ¼, thence follow said West right of way line of said Highway in a Northerly direction and to the North line of said NE ¼ SW ¼, thence run West and to the point of beginning.
