Steve Lansdown legal


WHEREAS, Steve D. Lansdown, by his Deed of Trust dated January 2, 2002, and recorded in the Recorder’s Office for Douglas County, Missouri, in Book 358 at Pages 87-89, secured a debt on the following described real estate, situated in the County of Douglas, State of Missouri, to-wit:

The SE ¼ NW ¼ and 7 acres off the North part of the NE ¼ SW ¼, the creek being the South line of said 7 acres; ALSO, a part of the SW ¼ NE ¼ described as commencing at the Southwest corner of said forty acre tract and running thence East 336 feet, thence North 360 feet, thence West 336 feet, thence South 360 feet to the place of beginning; All in Section 17, Township 26, Range 13.

EXCEPT all that part of the SE ¼ NW ¼ of Section 17, Township 26, Range 13, which lies North and East of the County Road; ALSO EXCEPT that part of the SE ¼ NW ¼ of Section 17, Township 26, Range 13, described as beginning at a point 360 feet North of the Southeast corner of said SE ¼ NW ¼, thence run West 500 feet, thence run North and to the South right-of-way line of the County Road, thence follow said County Road in an Easterly direction and to the point of intersection with the East line of the SE ¼ NW ¼, thence run South and to the point of beginning.

SUBJECT to right of way for County Road, as it now runs.

Which conveyance was silent as to a Trustee. The purpose of the deed of trust being to secure the payment of a certain note in said Deed of Trust described; and

WHEREAS, said Deed of Trust is silent as to the Trustee of said Deed of Trust; and

WHEREAS, a Trustee is needed to serve as Trustee, and Yolanda Hinote desires to appoint a Trustee to execute the said trusts in said Deed of Trust, as provided in said Deed of Trust; and

WHEREAS, Christopher D. Wade has been appointed Trustee by the holder of the note and deed of trust and said appointment having been agreed to by Steve D. Lansdown; and

WHEREAS, default was made and still continues in the payment of said note.

NOW, THEREFORE, at the request of the legal holder of said note, and in pursuance of the provisions of said Deed of Trust, the undersigned Trusteee will sell the property above described at public venue, to the highest bidder for cash, at the North Door of the Douglas County Courthouse in the City of Ava, State of Missouri, on

between the hours of 9:00 a.m. and 5:00 p.m., to-wit at 1:00 p.m., for the purpose of satisfying said indebtedness and the cost of executing this trust.
