WHEREAS, Kinsman-Elias Holdings, LLC, by its deed of trust dated October 1, 2010, recorded October 4, 2010, as Document No. 101434 of the records of Douglas County, Missouri, conveyed to Newton C. Brill, Trustee, the following described property, situated in the County of Douglas and State of Missouri, to-wit:

That part of the S1/2 of Lot 1 of the NW1/4 of Section 31, Township 27, Range 12, described as commencing at a point 540 feet north of the south line of said forty and on the westerly right-of-way line of Farm-to-Market Highway D and run thence west 435 feet, thence south 500 feet and to the northerly right-of-way line of Farm-to-Market Highway F, thence follow the northerly right-of-way line of said Highway F in an easterly direction and to the point of intersection with the westerly right-of-way line of said Highway D, thence follow said Highway D in a northerly direction and to the point of beginning;

Which conveyance was made to the said Newton C. Brill, Trustee, in trust, to secure the payment of a certain Note in said Deed of Trust described; and

WHEREAS, by Appointment of Substitute Trustee dated May 10, 2012, recorded May 14, 2012 as Document No. 120838 of the records of Douglas County, Missouri, Kenneth A. Wagoner was appointed as Substitute Trustee; and

WHEREAS, default was made and still continues in the payment of said Note;

NOW, THEREFORE, at the request of the legal holder of said note and in pursuance of the provisions of said Deed of Trust, the undersigned Trustee will sell the Property above described at public vendue to the highest bidder for cash, at the north door of Douglas County Courthouse in the City of Ava, Douglas County, Missouri on Wednesday, June 20, 2012, between the hours of 10:00 o’clock in the forenoon and 5:00 o’clock in the afternoon, at 1:00 p.m. for the purpose of satisfying said indebtedness and the cost of executing this trust.
