TRUSTEE’S SALE
WHEREAS, Kenneth Whedbee and Debra Whedbee, husband and wife, by their Deed of Trust dated July 18, 2002, and recorded in the Recorder’s Office for Douglas County, Missouri, in Book 366 at Pages 806-812, conveyed to Daniel P. Wade, Trustee, the following described real estate, situated in the County of Douglas, State of Missouri, to-wit:
A part of the SE ¼ NW ¼ and a part of the NE ¼ SW ¼ of Section 35, Township 27, Range 16, described as beginning at the Southeast corner of said SE ¼ NW ¼, thence run South approximately 4 feet and to the West right-of-way line of Missouri State Highway No. 5, thence run South 28 degrees 40 minutes West 80 feet, along said right-of-way line, thence run North 85 degrees 42 minutes West 421 feet along existing fence line, thence run North 9 degrees 36 minutes East 209.2 feet along existing fence line, thence run South 82 degrees 40 minutes East 400 feet along existing fence line and to the West right-of-way line of a “County Road”, thence run South 52 degrees 05 minutes East along the South line of said County Road and to the East line of said SE ¼ NW ¼, thence run South 81 feet and to the point of beginning.
ALSO any part of the SW ¼ NE ¼ and the NW ¼ SE ¼ of Section 35, Township 27, Range 16, which may lie South of the “County Road” and North or West of State Highway No. 5 (between the two roads).
SUBJECT to right-of-way for State Highway and County Road,as they now exist.
which conveyance was made to said Daniel P. Wade, Trustee, in Trust, to secure the payment of a certain note in said Deed of Trust described; and
WHEREAS, it is provided in and by the terms of said Deed of Trust that in case of the absence, death, or refusal to act, or disability in anywise, of the Trustee, at the request of the legal holder of said note, may request another individual to proceed to sell the property hereinbefore described; and
WHEREAS, Daniel P. Wade has resigned said trust and refused to act as Trustee; and
WHEREAS, Christopher D. Wade has been appointed Successor Trustee by the holder of the note; and
WHEREAS, default was made and still continues in the payment of said note.
NOW, THEREFORE, at the request of the legal holder of said note, and in pursuance of the provisions of said Deed of Trust, the undersigned Successor Trustee will sell the property above described at public venue, to the highest bidder for cash, at the North Door of the Douglas County Courthouse in the City of Ava, State of Missouri, on
Friday, March 16, 2012 between the hours of 9:00 A. M. and 5:00 P. M., to-wit: at 11:00 a.m., for the purpose of satisfying said indebtedness and the cost of executing this trust.
