WHEREAS, Dennis Garrison, a single person, by his Deed of Trust dated February 14, 2003, and recorded in the Recorder’s Office of Douglas County, Missouri, in Book 403 at Pages 63-72, conveyed to PR&H Trustee Services PC, Trustee, the following described real estate, situated in the County of Douglas, State of Missouri, to-wit:

Tract 1:

The W ½ of the NE ¼; and the NW ¼ of the SE ¼, all in Section 35, Township 26, Range 13.

 

Tract 2:

Beginning at the NW corner of the NW NE of Section 35, Township 26N, Range 13W for a place of beginning; thence 150 feet South, thence West to the East right of way line of Missouri State Highway 95, thence North following the right of way line to the North line of Section 35, Township 26, Range 13, thence East along said line to the place of beginning.

which conveyance was made to said PR&H Trustee Services PC, Trustee, in Trust, to secure the payment of a certain note in said Deed of Trust described; and

WHEREAS, it is provided in and by the terms of said Deed of Trust that in case of the absence, death, or refusal to act, or disability in anywise, of the Trustee, at the request of the legal holder of said note, may request another individual to proceed to sell the property hereinbefore described; and

WHEREAS, PR&H Trustee Services PC has resigned said trust and refused to act as Trustee; and

WHEREAS, Christopher D. Wade has been appointed Successor Trustee by the holder of the note; and

WHEREAS, default was made and still continues in the payment of said note.

NOW, THEREFORE, at the request of the legal holder of said note, and in pursuance of the provisions of said Deed of Trust, the undersigned Successor Trustee will sell the property above described at public venue, to the highest bidder for cash, at the North Door of the Douglas County Courthouse in the City of Ava, State of Missouri, on

Monday, January 30, 2012 between the hours of 9:00 a.m. and 5:00 p.m., to-wit: at 1:00 p.m., for the purpose of satisfying said indebtedness and the cost of executing this trust.
