NOTICE OF SUCCESSOR TRUSTEE’S SALE

 

For default in the payment of principal and interest now past due on a certain promissory note dated April 12, 2006 and secured by a deed of trust dated April 12, 2006 signed by Robert L. Carter and Shirley J. Carter, as husband and wife, and recorded on April 18, 2006, in Book 447 at Page 930 in the Office of the Recorder of Deeds for Douglas County, Missouri, as Document No. 060902, Lee J. Viorel, III will, at the request of the legal holder thereof, on Friday, the 5th day of September, 2014, between the hours of 9 o’clock a.m. and 5 o’clock p.m., specifically at 1 o’clock p.m. at the North Door of the Douglas County Courthouse, located at 203 Southeast Second Avenue, in the City of Ava, Missouri, sell at public vendue to the highest bidder for cash, the property in the deed of trust described as:

The SE ¼ of the NW ¼ of Section 23, Township 26, Range 16, except that part lying South of State Highway No.76 and except a strip deeded for highway purposes.  All being in Douglas County, Missouri.

Also except:

That part of the SE ¼ of the NW ¼ that lies North of State Highway No. 76 of Section 23, Township 26, Range 16 described as follows:  Commencing at the intersection of the North line of the SE ¼ of the NW ¼ and the West right of way line of Highway No. 76 thence West 744 feet to the point of beginning, thence run directly South parallel with the East line of said forty 647 feet and to the North line of State Highway No. 76, thence run West along the North right of way line of Highway No. 76, 582 feet and to the West line of said forty, thence run North along the West line of said forty 742 feet and to the NW corner, thence run East along the North line of said forty 582 feet and to the point of beginning, all being in Douglas County, Missouri.

Also except:

That part of the SE ¼ of the NW ¼ of Section 23, Township 26, Range 16 described as follows:  Beginning at the intersection of the North line of the SE ¼ of the NW ¼ and the west right of way line of Highway No. 76 for a point of beginning, thence West 744 feet, thence South 305 feet, thence East to the West right of way of Highway No. 76 thence Northerly along the West right of way line of Highway No. 76 to the point of beginning.

Subject to all easements, right of ways, restrictions or reservations of record.

for the purposes of satisfying the note and costs.
