NOTICE OF TRUSTEE’S SALE

Default having been made in the payment of the note described in and secured by deed of trust executed by Jeffrey A. Kirk dated June 6, 2013 instrument #131053 in the Office of the Recorder of Deeds of Douglas County, Missouri, conveying to John O. Russo, trustee, the following described real estate situated in Douglas County, Missouri, specifically:

An area of land located in the NW1/4 SE1/4 of Section 19, Township 27 North, Range 15 West, in Douglas County, Missouri, being more particularly described as follows: Beginning at the Northeast corner of said NW1/4 SE1/4, thence South 01 degrees 21 minutes 12 seconds West along the East line of said NW1/4 SE1/4 a distance of 736.55 feet to a 5/8 Inch iron pin, thence North 47 degrees 31 minutes 06 seconds West a distance of 442.05 feet to a 5/8 inch iron pin, thence North 02 degrees 26 minutes 08 seconds West a distance of 449.21 feet to a 5/8 inch iron pin on the North line of said NW1/4 SE1/4, thence South 88 degrees 15 minutes 47 seconds East along said line a distance of 362.66 feet to the point of beginning. Together with a 10 foot wide ingress and egress easement along the South line of the Property.

An area of land located in the NW1/4 SE1/4 of Section 19, Township 27 North, Range 15 West, in Douglas County, Missouri, being more particularly described as follows: Commencing at the Northeast corner of said NW1/4 SE1/4, thence North 88 degrees 15 minutes 47 seconds West along the North line of said NW1/4 SE1/4 a distance of 362.66 feet to a 5/8 Inch iron pin for a POINT OF BEGINNING, thence South 02 degrees 26 minutes 08 seconds East a distance of 449.21 feet To a 5/8 inch iron pin, thence South 33 degrees 07 minutes 13 seconds West a distance of 355.10 feet to the centerline of a 40 foot County Road; thence along said centerline on a curve to the left having a radius of 1454.50 feet, a chord bearing of North 50 degrees 20 minutes 13 seconds West, and a chord distance of 177.19 feet, follow along said curve a distance of 177.30 feet; thence North 53 degrees 49 minutes 45 seconds West a distance of 9.76 feet to a 5/8 inch iron pin, thence leaving said centerline North 01 degrees 44 minutes 13 seconds East a distance of 636.73 feet to a 5/8 inch iron pin on the North line of said NW1/4 SE 1//4; thence South 88 degrees 15 minutes 47 seconds East along said North line a distance of 300.06 feet to the point of beginning.

ALSO TOGETHER WITH all interest in and to a 20 foot wide ingress and egress EASEMENT (as conveyed to grantors herein by deed recorded in Document #080671), the centerline of which is described as follows:  Commencing at the Northeast corner of said NW1/4 SE1/4, thence North 88 degrees 15 minutes 47 seconds West along the North line of said NW1/4 SE1/4 a distance of 372.66 feet for a POINT OF BEGINNING, thence South 02 degrees 26 minutes 08 seconds East a distance of 439.96 feet, thence South 47 degrees 31 minutes 06 seconds East a distance of 456.17 feet, thence South 49 degrees 33 minutes 24 seconds West to the centerline of a county road for a point of termination.

and the entire and unpaid debts secured by said deed of trust having been declared due by the holder thereof, the duly appointed trustee will, at the request of the legal holder of said note and in accordance with the provisions of said deed of trust, on Monday, March 3, 2014, between the hours of 9:00 a.m. and 5:00 p.m. specifically at eleven o’clock (11:00 a.m.) in the morning, sell said property at public venue to the highest and best bidder for cash at the Main Door of the Douglas County Courthouse in the City of Ava, Douglas County, Missouri to satisfy said note and costs.
