NOTICE OF TRUSTEE’S SALE

 

WHEREAS, the Paul Francis Niebler Revocable Trust Agreement Dated 6-12-02, Paul Francis Niebler, Trustee, by its Deed of Trust dated December 24, 2008, and recorded in the Recorder’s Office of Douglas County, Missouri, in Document #090028, conveyed to Daniel P. Wade, Trustee, the following described real estate, situated in the County of Douglas, State of Missouri, to-wit:

That part of the NW ¼ SW ¼ of Section 14, Township 26, Range 16, described commencing at the point of intersection of the Easterly right-of-way line of State Highway #5 with the North line of said forty and run East on forty line 40 feet, thence South 38 degrees East 20 feet for a TRUE POINT OF BEGINNING; from this point run East parallel with the quarter section line a distance of 105 feet, thence South 38 degrees East 105 feet, thence West 105 feet to a point 40 feet East of the Easterly right-of-way line of said Highway, thence North 38 degrees West parallel with said right-of-way line to the POINT OF BEGINNING.

ALSO that part of the NW ¼ SW ¼ of Section 14, Township 26, Range 16 in Douglas County, Missouri, described as beginning where the North line of said forty intersects with the East line of State Highway No. 5 and run due East on North forty line 68 feet, thence run due South 20 feet, thence run South 38 degrees East 105 feet, for a place of beginning, thence run South 38 degrees East 25 feet, thence run North 59 degrees East approximately 35 feet to a point that is directly East of the place of beginning, thence run directly West approximately 45 feet to the place of beginning.  All being in Douglas County, Missouri.

LESS AND EXCEPT from above described land, that part of the NW ¼ SW ¼ of Section 14, Township 26, Range 16 described as commencing at the point of intersection of the Easterly right-of-way line of State Highway #5 with the North line of said forty and run East on forty line 40 feet, thence South 38 degrees East 20 feet, from this point run East parallel with the quarter section line a distance of 105 feet, thence South 38 degrees East 71 feet, to the POINT OF BEGINNING OF SAID EXCEPTION, thence continue South 38 degrees East 34 feet, thence West 60 feet to a point that is 50 feet West of the point of beginning of said exception, thence run North 59 degrees East 50 feet to the point of beginning of said EXCEPTION.  All in Douglas County, Missouri.

SUBJECT to Road right-of-ways and Easements, of record.

which conveyance was made to said Daniel P. Wade, Trustee, in Trust, to secure the payment of a certain note in said Deed of Trust described; and

WHEREAS, it is provided in and by the terms of said Deed of Trust that in case of the absence, death, or refusal to act, or disability in anywise, of the Trustee, at the request of the legal holder of said note, may request another individual to proceed to sell the property hereinbefore described; and

WHEREAS, Daniel P. Wade has resigned said trust and refused to act as Trustee; and

WHEREAS, Christopher Wade has been appointed Successor Trustee by the holder of the note; and

WHEREAS, default was made and still continues in the payment of said note.

NOW, THEREFORE, at the request of the legal holder of said note, and in pursuance of the provisions of said Deed of Trust, the undersigned Successor Trustee will sell the property above described at public venue, to the highest bidder for cash, at the North Door of the Douglas County Courthouse in the City of Ava, State of Missouri, on Friday, November 1, 2013 between the hours of 9:00 A. M. and 5:00 P. M., to-wit: at 1:00 P. M., for the purpose of satisfying said indebtedness and the cost of executing this trust.
