NOTICEOF TRUSTEE’S SALE

WHEREAS, RoJo Properties LLC, a Missouri limited liability company, by their deed of trust dated March 9, 2006, and recorded March 17, 2006, in Book 446, Page 564-575, Doc #060617, as corrected by a correction deed of trust dated March 9, 2006, and recorded June 27, 2011, as instrument #110997, in the office of the recorder of deeds for Douglas County, Missouri, conveyed to Charles C. Cantrell, Trustee, the following described property situated in Douglas County, Missouri:

All of Lot One (1), WAL-MART ADDITION 1st PLAT, a subdivision in the City of Ava, Douglas County, Missouri, and being more particularly described as follows: Beginning at the Southeast corner of said Lot 1; thence North 60 degrees 37 minutes 04 seconds West along the South line of said Lot 1, a distance of 342.15 feet; thence North 29 degrees 22 minutes 56 seconds East along the West line of said Lot 1, a distance of 120.82 feet to the beginning of a curve to the right and tangent to the last described course; thence along said curve to the right having a radius of 59.00 feet, an arc distance of 91.22 feet to the point of reverse curvature, said point on the South right of way line of Missouri Highway No. 14; thence along said curve to the left having a radius of 1472.70 feet, an arc distance of 143.75 feet; thence South 00 degrees 10 minutes 44 seconds West along the East line of said Lot 1, a distance of 45.58 feet; thence South 17 degrees 41 minutes 39 seconds East, along the East line of said Lot 1, a distance of 104.44 feet; thence South 01 degrees 11 minutes 38 seconds West, along the East line of said Lot 1, a distance of 90.16 feet to the Point of Beginning.

An irregularly shaped ingress and egress easement being a part of Lot 2 of WAL-MART ADDITION 1st PLAT as described in the Douglas County, Missouri Recorder’s Office in Plat Book 5, Page 9 and said Parcel being more particularly described as follows:  Beginning at the Southwest corner of Lot 1, WAL-MART ADDITION 1st PLAT; thence South 60 degrees 34 minutes 18 seconds East, 342.15 feet to a point lying on Westerly right-of-way of N.W. 13th Street; thence along said Westerly right-of-way, South 01 degrees 13 minutes 47 seconds West, 37.65 feet; thence leaving said Westerly right-of-way, North 89 degrees 04 minutes 47 seconds West, 52.30 feet; thence North 60 degrees 39 minutes 02 seconds West, 368.02 feet; thence North 29 degrees 22 minutes 56 seconds East, 156.63 feet; thence 130.79 feet along a 90.00 foot radius curve to the left whose chord bears North 12 degrees 14 minutes 53 seconds West for a distance of 119.58 feet to a point lying on the Southerly right-of-way of State Highway 14; thence along said Southerly right-of-way 191.15 feet along a 1466.94 foot radius curve to the left whose chord bears South 58 degrees 19 minutes 43 seconds East for a distance of 191.02 feet; thence leaving said Southerly right-of-way, 91.27 feet along a 58.80 foot radius curve to the left whose chord bears South 73 degrees 40 minutes 51 seconds East for a distance of 82.38 feet; thence South 29 degrees 17 minutes 28 seconds West, 120.82 feet to the point of beginning. All lying in the SW1/4NE1/4 and also lying in the NW1/4NE1/4 of Section 10, Township 26 North, Range 16 West, in the City of Ava, Douglas County, Missouri.  Containing 35,147 square feet, or 0.807 acres, more or less, bearings based on grid North of the Missouri coordinate system of 1983, Central Zone conditions and monuments are as shown on Anderson Engineering, Inc. Drawing Number WB 107-140.

which conveyance was made to Charles C. Cantrell, Trustee, in trust to secure the payment of one promissory note in the Deed of Trust described; and

WHEREAS, default was made and still continues in the payment of said note;

NOW THEREFORE, I, Charles C. Cantrell, Trustee, will sell the property above described at public sale, to the highest bidder for cash, at the North front door of the Douglas County Courthouse, in the City of Ava, Douglas County, Missouri, on Friday, February 15, 2013, between the hours of 9 o’clock a.m. and 5 o’clock p.m., and more particularly at 1:00 p.m., for the purpose of satisfying said indebtedness and the cost of executing this trust.
