NOTICE OF TRUSTEE’S SALE

WHEREAS, George Erwin and Kim Erwin, husband and wife, by their Deed of Trust dated November 10, 2011, and recorded in the Recorder’s Office for Douglas County, Missouri, as Document No. 111759, conveyed to Daniel P. Wade, Trustee, the following described real estate, situated in the County of Douglas, State of Missouri, to-wit:

All that part of the NW1/4 NW1/4 of Section 17, Township 25, Range 15, which lies North and West of the “Norman Alcorn Road.” Said Road more fully described on Survey for Norman Alcorn by Schnurbusch Land Services on March 21, 1985 as per description of road in Book 212 at Page 305 in the office of the Douglas County Recorder.

SUBJECT to an EASEMENT for ingress and egress along and over a strip of land for road purposes only as described and recorded on April 13, 1994 in Record Book 279 at Page 777 in the office of the Douglas County Recorder.

SUBJECT to an EASEMENT for ingress and egress along and over a strip of land for road purposes only as described and recorded on January 25, 2001 in Record Book 339 at Pages 738-741 in the office of the Douglas County Recorder.

TOGETHER with an EASEMENT of ingress and egress over the easement as it appears of record in Book 277 at Pages 353-354 and described as a strip of land for road purposes only for “Road right of way in part of Sections 18 and 17 in Township 25, Range 15 per deed description recorded in Book 212 at Page 305 in the office of the Douglas County Records and also a 30 foot road as now located across the SW1/4 SW1/4 of Section 8, Township 25, Range 15.”

SUBJECT to all restrictions or covenants as per EASEMENT of record in Book 277 at Page 353 in the office of the Douglas County Recorder.

Which conveyance was made to said Daniel P. Wade, Trustee, in Trust, to secure the payment of a certain note in said Deed of Trust described; and

WHEREAS, default was made and still continues in the payment of said note.

NOW, THEREFORE, at the request of the legal holder of said note, and in pursuance of the provisions of said Deed of Trust, the undersigned Trustee will sell the property above described at public venue, to the highest bidder for cash, at the North Door of the Douglas County Courthouse in the City of Ava, State of Missouri, on Friday, November 30, 2012 between the hours of 9:00 a.m. and 5:00 p.m., to-wit: at 1:00 p.m., for the purpose of satisfying said indebtedness and the cost of executing this trust.
